Dealing with the death of a family member can be difficult, especially if that family member dies abruptly. When walking her dog in November of last year a Florida woman was hit and killed by a car. According to witnesses, the driver didn't call 911 after the accident, and it took her nearly 12 hours to report it.
This death could have possibly been prevented had the person driving the vehicle called 911 immediately. The negligence of the driver has now cause severe emotional pain for the family who lost their loved one. This negligence caused them to file a wrongful death lawsuit against the driver.
Wrongful death lawsuits are usually filed when someone's negligent actions cause the death of another person. The daughter of the woman who was killed filed the lawsuit and was awarded $1.25 million. She said the lawsuit was not about money, but to prove that the woman's actions led to the death of her mother.
The driver has had no charges filed against her, and the investigation of the crash is still ongoing. The money from the lawsuit will be paid by the driver's insurance company. Many times people aren't seeking the actual money from a wrongful death lawsuit, but instead file these lawsuits as a way of seeking justice for the death of their loved one.
